These Terms of Service ("Terms") govern the use of PinkDraft (pinkdraft.io), a web-based screenwriting application operated by Arne Palluck, Brahmsstraße 27, 95448 Bayreuth, Germany ("we", "us", "PinkDraft"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use PinkDraft.
PinkDraft provides tools for structuring, writing, and managing screenplays. Features include story structure frameworks, beat-to-screenplay linking, character and location management, and export functionality. The service is provided "as is" and may be updated, modified, or discontinued at any time.
You must provide accurate information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for more than 12 months.
All rights to the PinkDraft application — including but not limited to its source code, user interface design, visual design, layout, story wheel concept, framework visualizations, icons, graphics, and all other creative and technical elements — remain the exclusive property of Arne Palluck / PinkDraft. You may NOT: — Copy, reproduce, or redistribute PinkDraft's design, user interface, or visual identity — Reverse-engineer, decompile, or extract PinkDraft's source code for the purpose of creating a competing product — Create derivative works based on PinkDraft's distinctive design elements, including the story wheel visualization — Use PinkDraft's name, logo, or branding in any way that suggests endorsement or affiliation This prohibition applies regardless of how the design or code was obtained, including through browser developer tools or network inspection.
You retain full ownership of all screenplays, notes, characters, locations, and other creative content you create using PinkDraft ("Your Content"). We do not claim any rights to Your Content. We will never sell, share, or use Your Content for any purpose other than providing the service to you. You may export and delete Your Content at any time.
You agree not to: — Use the service for any unlawful purpose — Attempt to gain unauthorized access to the service or other users' accounts — Interfere with the operation of the service (e.g. DDoS, automated scraping) — Share your account credentials with third parties — Use the service to store or distribute content that violates applicable laws
Paid subscriptions are billed in advance on a monthly or yearly basis through Stripe. Prices are displayed on the pricing page and include applicable taxes. You may cancel your subscription at any time. Upon cancellation, you retain access until the end of the current billing period. Refunds are not provided for partial billing periods. We reserve the right to change pricing with 30 days' notice. Price changes do not affect active billing periods.
While we take reasonable measures to protect your data, PinkDraft is not a backup service. We strongly recommend that you regularly export your projects. We are not liable for data loss caused by technical failures, server issues, or force majeure.
To the extent permitted by law, PinkDraft is provided without warranty of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you have paid for the service in the 12 months preceding the claim. This limitation does not apply in cases of intentional misconduct or gross negligence.
You may delete your account at any time through the profile settings. We may terminate or suspend your account if you violate these Terms. Upon termination, your data will be deleted within 30 days.
These Terms are governed by the laws of the Federal Republic of Germany. The courts of Bayreuth, Germany, shall have exclusive jurisdiction over any disputes. Mandatory consumer protection laws of your country of residence remain unaffected.
We may update these Terms at any time. Material changes will be communicated via email or through a notice in the application. Continued use of PinkDraft after changes constitutes acceptance. The current version is always available at pinkdraft.io/legal#terms.

We only process personal data as necessary to provide our service PinkDraft (pinkdraft.io).
Data we process: — Email address (for account and login) — Password (stored only as a bcrypt hash, never in plain text) — Project data (screenplays, notes, characters, locations) — IP address (technically required for every page request) — Payment data (processed exclusively by Stripe, not by us)
— Performance of contract (Art. 6 (1)(b) GDPR): To provide the service, manage your account, and store your projects. — Legitimate interest (Art. 6 (1)(f) GDPR): For the technical operation and security of the service (e.g. log files, IP addresses).
Our service uses Cloudflare (Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA) as a reverse proxy and CDN. Cloudflare processes IP addresses and technical connection data. We use Stripe (Stripe, Inc., 354 Oyster Point Blvd, South San Francisco, CA 94080, USA / Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland) to process payments. When you make a purchase, your payment details (credit card number, IBAN, etc.) are processed exclusively by Stripe. We do not have access to your full payment information. We only receive a confirmation of payment status and your email address from Stripe. Stripe is PCI DSS Level 1 certified and certified under the EU-US Data Privacy Framework. PinkDraft uses NO tracking cookies, no Google Analytics, and no advertising trackers. We only use technically necessary mechanisms (JWT tokens for authentication). A cookie consent banner is therefore not required.
PinkDraft offers the ability to save your projects on our servers. This storage is provided as a convenience and is NOT a guaranteed backup service. We assume no liability for loss of data due to server failures, technical errors, or force majeure. PinkDraft allows you to download your projects as files (export) at any time. We strongly recommend that you regularly create your own backup copies of your work. Your account data is stored as long as your account exists. You may delete your account and all associated data at any time. After deletion, all data will be permanently removed within 30 days. Server backups are retained for a maximum of 30 days and automatically deleted thereafter.
